Drone regulations and operating rules are in place in Austria, Czech Republic, Denmark, France, Germany, Ireland, Italy, the Netherlands, Poland, Spain, Sweden and the UK . In Belgium, the Minister of Mobility Jacqueline Galant is informed about the reasoned opinion of the Commission on the Belgian Royal Decree, which regulates the professional and private use of drones. She will finalize the Royal Decree based on some technical remarks: "Belgium has always said to adapt to European regulations".
In addition to regulatory and legal challenges, there are a myriad of complex liability and coverage issues related to insuring the use of commercial drones. |
There is no harmonized liability framework in the EU. Damage caused by drones to third parties depends on national rules. Strict liability rules (i.e. the operator is liable without that the victim must demonstrate the fault) exist in the majority of EU states.
The following general types of coverage will be needed for the use of drones and ancillary business activities: liability, personal injury, invasion of privacy, property and workers’ compensation. For those insurance professionals who are willing to step in, learn, and not take a passive “wait and see approach,” there are tremendous opportunities in the rapidly expanding field of commercial UAS.
